Terms and Conditions

These Terms and Conditions govern the use of the protective-cases.eu online store and the purchase of products through the webshop. By using the website and/or placing an order, the customer confirms that they are familiar with these terms and that they accept them.

2. Scope of application

These terms apply to purchases made through the protective-cases.eu online store. Applicable consumer protection regulations for distance purchases apply to consumer customers.

Special terms stated in an offer, pro forma invoice, order confirmation or contract may apply to business customers, legal entities, project purchases, purchases based on quotations, public procurement and special orders. In the event of any discrepancy between these terms and a special offer or contract, the terms stated in the special documentation shall prevail.

3. Products and product information

We make every effort to ensure that product descriptions, photographs, technical specifications, compatibility information and other information on the webshop are accurate and up to date. Nevertheless, minor variations may occur in colour display, packaging, technical details, manufacturer markings or availability. Product photographs are for illustrative purposes and may not always fully correspond to all details of the delivered product.

4. Product availability

The display of products on the webshop does not necessarily mean that the product is always immediately available from stock. Availability depends on stock levels, suppliers, manufacturers and logistics.

We reserve the right to change product availability, delivery times or withdraw products from the offer without prior notice. Different delivery times, terms and cancellation rules may apply to specially ordered products, made-to-order products, special configurations or products made according to the customer’s specifications.

5. Prices

All prices displayed on the webshop are stated in the currency shown on the product page or at checkout. Shipping costs, if not included in the product price, are displayed before the order is completed or are stated in a separate Shipping Policy.

We reserve the right to change prices, promotions, discounts and promotional terms without prior notice. The price applicable to the customer is the price valid at the time the order is placed.

EU rules require that, before purchase, the consumer receives clear information about the trader, the price, any additional costs, delivery and the rights they have when purchasing at a distance.

6. Placing an Order and Conclusion of the Contract

The display of products on the webshop does not constitute a legally binding offer, but an invitation for the customer to place an order. The customer places an order by completing the checkout process.

The contract is considered concluded when the seller receives the order and sends the customer an order confirmation or otherwise clearly confirms acceptance of the order.

We reserve the right to refuse or cancel an order in the event of an obvious error in the price or product description, incorrectly displayed availability, a technical error in the webshop, suspected misuse, inability to deliver or other justified reasons. If payment has already been made, the paid amount will be refunded to the customer without unnecessary delay.

7. Payment

The customer may use the payment methods offered on the webshop at the time of purchase. The order may be processed only after successful payment authorisation or after the payment has been recorded, depending on the selected payment method.

Special payment terms stated in an offer, pro forma invoice or contract may apply to business customers, project purchases and purchases based on quotations.

8. Delivery

Delivery is carried out in the areas and under the terms stated on the webshop or in a separate Shipping Policy. Delivery times are estimated and may depend on product availability, the selected delivery method, the country of delivery, carrier operations, customs procedures and other circumstances beyond our reasonable control.

9. Consumer Right of Withdrawal

A consumer customer has the right to withdraw from a distance contract within 14 days without giving any reason, in accordance with applicable regulations.

Detailed terms for exercising this right, exceptions, the method of returning goods and refund procedures are regulated in our Returns and Refund Policy.

10. Exceptions and Special Orders

The right of withdrawal does not apply to products made according to the customer’s specifications or clearly personalised products. This may include personalised products, custom-made goods, special configurations, custom foam and products manufactured or sourced according to the customer’s special request.

Special return, cancellation or complaint terms may apply to B2B purchases, project purchases, purchases based on quotations and special orders.

11. Complaints, Non-Conformity of Goods and Warranties

If the customer receives the wrong product, a product with a material defect, a product damaged in transport or a product that is not in conformity with the contract, the customer should contact us as soon as possible at prodaja@mediapark.hr, providing the order number and a description of the issue.

Consumer customers have statutory rights in the event of non-conformity of goods with the contract. Any commercial manufacturer’s warranty, if applicable, does not exclude or replace the customer’s statutory rights.

12. Business Customers

Different terms from those applicable to consumers may apply to business customers, legal entities, public procurement, purchases based on quotations, project purchases and special configurations.

Such purchases may be subject to specially agreed terms regarding payment, delivery times, returns, complaints, warranties, liability and order cancellation.

13. Liability

We are not liable for delays or inability to deliver caused by circumstances beyond our reasonable control, including delays caused by suppliers, manufacturers, carriers, customs procedures, technical difficulties, force majeure or other extraordinary circumstances.

We are not liable for indirect damage, loss of profit, loss of data or consequences of improper use of products, except to the extent that such liability cannot be excluded under mandatory law.

14. Intellectual Property

The content of the webshop, including texts, product descriptions, photographs, graphics, logos and other materials, is protected by intellectual property rights.

Copying, distribution, publication or any other use of the webshop content is not permitted without prior written approval, unless permitted by law.

15. Privacy and Personal Data Processing

Personal data is processed in accordance with our Privacy Policy and applicable personal data protection regulations.

17. Governing Law and Disputes

These Terms and Conditions and contracts concluded through the webshop are governed by the laws of the Republic of Croatia, with the mandatory application of consumer protection rules where applicable.

We will endeavour to resolve any disputes amicably.

18. Final Provisions

We reserve the right to amend these Terms and Conditions at any time. The terms valid at the time the order is placed apply to the purchase, unless mandatory law provides otherwise.
